Welcome to Tuitionites ("Tuitionites", "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Tuitionites website, platform, services, applications, features, subscriptions, credits, and any related services available through www.tuitionites.com(opens in a new tab) (collectively, the "Platform").

By accessing, browsing, registering on, or using the Platform in any manner, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, Refund Policy, and any other policies published by Tuitionites from time to time.

If you do not agree with these Terms, you must immediately discontinue using the Platform.

1. Definitions

For the purposes of these Terms:

  • Platform means the Tuitionites website, applications, services, software, features, subscriptions, credits, and all associated systems.
  • User means any person accessing or using the Platform.
  • Student includes students, parents, guardians, or any individual searching for tuition services.
  • Tutor means any individual offering tuition or educational assistance through the Platform.
  • Subscription means any paid Premium Plan offered by Tuitionites.
  • Credits mean the digital credits issued under eligible subscription plans that allow users to unlock contact information as permitted by the Platform.
  • Content includes text, photographs, profile information, documents, reviews, messages, and all other material uploaded or submitted by users.

2. Acceptance of Terms

By creating an account or using any part of the Platform, you represent and warrant that:

  • You have read these Terms in their entirety.
  • You understand and agree to comply with these Terms.
  • You possess the legal capacity to enter into a binding agreement.
  • All information provided by you is true, accurate, and complete.
  • You will comply with all applicable laws while using the Platform.

These Terms constitute a legally binding agreement between you and Tuitionites.

3. Eligibility

The Platform is intended for individuals who are 18 years of age or older.

Parents or legal guardians may create an account, post tuition requirements, communicate with tutors, purchase subscriptions, and otherwise use the Platform on behalf of their minor children.

By using the Platform, you represent that you satisfy the applicable eligibility requirements.

Tuitionites reserves the right to refuse registration, suspend access, or terminate any account that does not satisfy these eligibility requirements.

4. Nature of the Platform

Tuitionites is solely a technology platform that enables students and tutors to discover each other and exchange contact information through the Platform's credit-based unlocking system.

Our services are limited to facilitating connections between users.

Tuitionites:

  • does not provide tuition classes;
  • does not employ tutors;
  • does not recruit tutors;
  • does not guarantee tuition opportunities;
  • does not guarantee academic results;
  • does not negotiate tuition fees;
  • does not schedule classes;
  • does not supervise tuition sessions;
  • does not monitor teaching quality;
  • does not participate in agreements between users; and
  • does not act as an agent, representative, employer, contractor, educational institution, or partner of any user.

Once contact information has been exchanged, all further communication, negotiations, agreements, tuition arrangements, payments, scheduling, cancellations, disputes, and all other interactions occur solely between the student (or parent/guardian) and the tutor.

5. User Registration

To access certain features of the Platform, users must register and create an account.

Users agree to:

  • provide accurate, current, and complete information;
  • maintain the accuracy of their profile;
  • promptly update any changes to their information;
  • maintain only one account unless expressly permitted by Tuitionites; and
  • use only their own identity while registering.

Providing false, misleading, incomplete, fraudulent, or impersonated information is strictly prohibited and may result in immediate suspension or permanent termination of the account without liability on the part of Tuitionites.

6. Mobile Number Verification

User accounts are authenticated using mobile number and One-Time Password (OTP) verification.

Users are solely responsible for maintaining control over their registered mobile number.

Any activity performed using a successfully verified account shall be deemed to have been performed by the registered account holder.

Tuitionites shall not be liable for any loss arising from unauthorized access resulting from the user's failure to secure their mobile number or device.

7. User Responsibilities

Every user agrees to:

  • provide truthful and accurate information;
  • keep profile information updated;
  • comply with all applicable laws;
  • communicate respectfully with other users;
  • use the Platform only for legitimate educational purposes;
  • maintain the confidentiality of account credentials and devices; and
  • immediately notify Tuitionites if unauthorized account access is suspected.

Users remain solely responsible for all activity conducted through their accounts.

8. Student Responsibilities

Students (including parents or guardians) acknowledge and agree that they are solely responsible for:

  • selecting an appropriate tutor;
  • verifying the tutor's identity;
  • verifying educational qualifications and experience;
  • independently conducting all necessary due diligence and satisfying themselves regarding the tutor's identity, residential address, qualifications, credentials, experience, background, suitability, and authenticity of any documents or information provided before entering into any tuition arrangement, as Tuitionites does not undertake or guarantee such verification;
  • negotiating tuition fees;
  • deciding the location of classes;
  • deciding whether tuition will be online or offline;
  • determining the curriculum, study material, teaching methodology, and duration of classes;
  • making payments directly to tutors; and
  • evaluating the suitability of any tutor before entering into a tuition arrangement.

Tuitionites, being a Platform Only service, does not verify, investigate, validate, endorse, certify, or guarantee the identity, qualifications, certifications, experience, credentials, background, character, suitability, authenticity, accuracy, completeness, or legality of any information, document, claim, or representation made by any tutor. Users are solely responsible for conducting their own independent due diligence and verification before entering into any tuition arrangement. To the fullest extent permitted by applicable law, Tuitionites shall not be responsible or liable for any decision, action, omission, loss, damage, claim, dispute, or consequence arising directly or indirectly from a user's reliance on any information, document, or representation available on or through the Platform.

9. Tutor Responsibilities

Tutors acknowledge and agree that they are solely and exclusively responsible for:

  • maintaining accurate, complete, and up-to-date profile information at all times;
  • ensuring that all qualifications, certifications, experience, skills, achievements, documents, and other information submitted or displayed on the Platform are truthful, accurate, genuine, and not misleading;
  • complying with all applicable laws, regulations, governmental requirements, and professional obligations;
  • independently verifying the identity and relevant information of students or parents before entering into any tuition arrangement, where appropriate;
  • independently negotiating tuition fees, schedules, locations, teaching modes, subjects, and all other terms relating to any tuition arrangement;
  • deciding, at their sole discretion, whether to accept, reject, continue, or discontinue any tuition opportunity;
  • maintaining professional, ethical, lawful, and respectful conduct in all interactions with students, parents, and other users;
  • performing tuition services with reasonable skill, care, diligence, and professionalism;
  • fulfilling all commitments, representations, and obligations voluntarily agreed upon with students or parents; and
  • ensuring that their use of the Platform and the tuition services provided by them do not infringe the rights of any third party or violate any applicable law.

Tutors acknowledge and agree that they act solely in their personal and independent capacity while using the Platform and are not employees, representatives, agents, contractors, consultants, partners, franchisees, joint venturers, or authorized representatives of Tuitionites.

Nothing contained on the Platform or in these Terms shall be construed as creating any employment relationship, agency, partnership, joint venture, fiduciary relationship, or other legal association between Tuitionites and any tutor.

Tuitionites does not supervise, direct, control, evaluate, monitor, or manage the professional activities, teaching methods, conduct, communications, or services provided by tutors.

Tutors shall be solely responsible for all taxes, statutory dues, professional liabilities, licenses, permits, registrations, regulatory compliances, contractual obligations, civil liabilities, criminal liabilities, and any other legal responsibilities arising out of or relating to their use of the Platform or the tuition services provided by them.

To the fullest extent permitted by applicable law, each tutor agrees to indemnify and defend Tuitionites, its parent company, affiliates, owners, directors, officers, employees, agents, representatives, licensors, successors, assigns, and service providers against any and all claims, demands, actions, proceedings, liabilities, losses, damages, penalties, fines, costs, expenses, and reasonable legal fees arising out of or relating to the tutor's use of the Platform, acts, omissions, services, conduct, negligence, misconduct, representations, profile information, qualifications, communications, breach of these Terms, breach of any agreement with a student or parent, violation of applicable law, infringement of any third-party rights, or any dispute involving the tutor. This indemnification obligation shall survive the suspension, restriction, deactivation, termination, or closure of the tutor's account and shall continue to apply notwithstanding the tutor's cessation of use of the Platform. It shall apply to the fullest extent permitted by applicable law, regardless of whether any claim, demand, action, or proceeding is brought by a student, parent, guardian, governmental authority, regulatory body, or any other third party.

10. User Verification

While Tuitionites implements reasonable measures to maintain the integrity of the Platform, we do not guarantee the identity, qualifications, credentials, experience, intentions, conduct, or suitability of any user.

All users are strongly encouraged to independently verify the identity and credentials of the other party before entering into any tuition arrangement.

Users acknowledge that any decision to communicate, meet, hire, teach, or make payments to another user is entirely at their own discretion and risk.

11. Accuracy of User Information

All information displayed on tutor profiles, student profiles, tuition requirements, messages, and other user-generated content is supplied by the respective users.

Tuitionites does not warrant or guarantee the completeness, accuracy, reliability, legality, authenticity, or correctness of any user-generated information.

Users are solely responsible for verifying all information before relying upon it.

12. No Guarantee of Matches

Registration on Tuitionites, whether free or paid, does not guarantee:

  • finding a tutor;
  • finding a student;
  • receiving tuition opportunities;
  • receiving responses from other users;
  • successful contact after unlocking;
  • tuition confirmations;
  • successful tuition engagements;
  • academic improvement; or
  • any minimum number of tuition opportunities.

Subscriptions grant access only to the Platform features and credits included within the purchased plan and do not constitute a guarantee of successful outcomes.

13. Multiple Accounts and Contact Sharing

Each user may maintain only one account on the Platform unless expressly authorized in writing by Tuitionites.

Users shall not create, operate, or maintain multiple accounts for the purpose of circumventing Platform restrictions, subscription limitations, credit usage, promotional offers, account suspensions, or any other Platform policies.

Users shall not share, sell, rent, lease, transfer, publish, distribute, or otherwise disclose any contact information obtained through the Platform to any third party, except as reasonably necessary for establishing a genuine tuition arrangement between the concerned student and tutor.

Any misuse of unlocked contact information, including but not limited to commercial exploitation, unauthorized distribution, or sharing with third parties, is strictly prohibited.

Violation of this section may result in immediate suspension or permanent termination of one or more associated accounts, forfeiture of any remaining subscriptions or credits, and any other action deemed appropriate by Tuitionites, without any refund.

14. Fraud Prevention and Payments Between Users

Tuitionites strongly advises all users to exercise appropriate caution before making or accepting any payment.

Students and parents are advised not to make advance payments to tutors unless they are fully satisfied with the tutor's identity, credentials, and the agreed arrangement.

Similarly, tutors should independently verify the identity of students or parents before accepting any payment or commencing tuition services.

All tuition fees, reimbursements, deposits, or other financial arrangements are negotiated and settled exclusively between the concerned users.

Tuitionites is not involved in, does not process, and does not guarantee any payment made between users.

Accordingly, Tuitionites shall not be responsible or liable for any financial loss, fraud, scam, chargeback, unauthorized transaction, non-payment, advance payment dispute, or any other monetary dispute arising between users.

15. Individual Tutor Plans and Commercial Use

Individual Tutor subscription plans are intended solely for independent tutors offering their personal educational services.

Coaching institutes, tuition agencies, educational organizations, businesses, franchises, placement agencies, or any other commercial entities shall not use Individual Tutor subscription plans.

If Tuitionites reasonably determines that an account is being operated on behalf of an organization or commercial entity while using an Individual Tutor subscription, Tuitionites may suspend or permanently terminate such account without prior notice and without any refund.

Organizations or commercial entities wishing to use the Platform for business purposes may contact Tuitionites separately and may be subject to different commercial terms, pricing, or agreements.

16. Permitted Use of Contact Information

Contact information unlocked through the Platform is provided solely for the purpose of establishing a genuine tuition relationship between the concerned student and tutor.

Users shall not use any contact information obtained through the Platform for advertising, unsolicited marketing, recruitment, mass messaging, data collection, commercial solicitation, resale, or any purpose unrelated to the intended educational engagement.

Users remain solely responsible for ensuring that their use of contact information complies with all applicable laws.

17. Platform Only

Tuitionites solely provides a technology platform that enables students and tutors to discover one another and exchange contact information through the Platform.

Any tuition contract, teaching engagement, employment relationship, payment arrangement, commercial understanding, educational agreement, or any other transaction entered into between users exists exclusively between those users.

Tuitionites is not a party to any such arrangement and assumes no responsibility, obligation, or liability arising from any relationship established through the Platform.

To the fullest extent permitted by applicable law, users hereby release and discharge Tuitionites, its owners, directors, officers, employees, affiliates, representatives, successors, and assigns from any and all claims, demands, liabilities, losses, damages, costs, expenses, or disputes arising directly or indirectly out of any interaction, agreement, tuition arrangement, payment, or relationship between users.

18. Availability of Tutors and Tuition Opportunities

Tuitionites does not guarantee that tutors, students, tuition requirements, or educational opportunities will be available in every city, locality, subject, class, course, examination, language, or teaching mode.

The availability of tutors and tuition requirements depends entirely upon user registrations, Platform activity, and user preferences.

Accordingly, Tuitionites makes no representation or warranty regarding the availability of suitable tutors, students, or tuition opportunities for any particular requirement.

19. Changes to Subscription Plans

Tuitionites reserves the exclusive right, at its sole discretion, to introduce, modify, discontinue, suspend, replace, or revise any subscription plan, Premium Plan, credit allocation, pricing, validity period, features, benefits, eligibility criteria, or promotional offer at any time without prior notice.

Any such modification shall apply prospectively unless otherwise expressly stated by Tuitionites and shall not affect completed purchases except as required by applicable law.

20. Experience Certificates and Endorsements

Tuitionites does not issue employment certificates, experience certificates, teaching certifications, recommendation letters, endorsements, or any similar professional credentials to tutors.

Registration on the Platform shall not be construed as employment, engagement, accreditation, certification, or endorsement by Tuitionites.

21. User Safety

Users are solely responsible for exercising appropriate caution while communicating with, meeting, hiring, or engaging with another user.

Where physical meetings are involved, users are encouraged to independently verify identities, confirm relevant information, choose appropriate meeting locations where suitable, and exercise reasonable judgment before entering into any tuition arrangement.

Tuitionites does not supervise, monitor, or control offline interactions between users and shall not be responsible for the conduct, actions, omissions, safety, or security of any user.

22. General Release of Liability

To the fullest extent permitted by applicable law, each user expressly releases, waives, and forever discharges Tuitionites, its owners, directors, officers, employees, affiliates, representatives, successors, licensors, and assigns from any and all claims, demands, proceedings, actions, liabilities, damages, losses, costs, expenses, or causes of action of every kind and nature, whether known or unknown, arising directly or indirectly out of or in connection with the use of the Platform, any interaction between users, or any services obtained through the Platform.

This release shall survive the suspension, termination, or closure of a user account and the cessation of use of the Platform.
